Of course they could. But I would be really surprised if they do. I have been looking at quite a few cases where FINRA did not approve, common thread is past delinquent reporting. HERB has done the work to audit and attempted to get SEC Current with C filing, but it doesn't seem to be enough?

I would be happy to be wrong on this of course.
