I have pacer too and none of that has anything even remotely to do with or about BioAmber.
So how does a lawsuit between parties that are not BioAmber or involve BioAmber have anything to do with the former shareholders of BioAmber? Remember the last lawsuit that was actually against BioAmber that was supposed to be the last hurdle holding up the big fake payday? Well that ended long ago and had ZERO to do with any shareholder payday so how would this one having nothing to do with BioAmber be the last hurdle?
WHEREAS, as of April 13, 2023, the Parties’ Settlement Agreement was fully executed, triggering various obligations as stated therein, and which conditions the dismissal of this action on the performance of certain obligations required to be completed within thirty (30) calendar days of execution;
JOINT MOTION TO DISMISS AND FOR ENTRY OF STIPULATED ORDER
WHEREAS, the Parties request that all dates and deadlines be vacated and the case set for dismissal with prejudice on June 12, 2023 (without further action), unless an extension is requested by one or more of the Parties;
WHEREAS, the Parties request that the U.S. District Court for the Southern District of California retain jurisdiction over the Parties, pursuant to California Code of Civil Procedure § 664.6, to enforce the terms of the Settlement Agreement until its terms are fully performed; and,
WHEREAS, the Parties have agreed to and move, as follows;
THE PARTIES HEREBY JOINTLY MOVE AND STIPULATE, by and between the undersigned counsel, to:
1. Dismiss this action with prejudice, which dismissal shall be entered and effective as of June 12, 2023 (without any further action necessary);
2. Vacate all dates, deadlines and proceedings in this action; and,
3. Retention of jurisdiction by this Court over the Parties in this action to
enforce the terms of the Settlement Agreement until its terms are fully performed.
