3 months and a day since the motion was filed in SDNY. In the last hearing Judge Alvin was obviously annoyed about the delays and ordered the lawyers to file the motion in 3 weeks when they requested a month. I am surprised that it is taking this long for him to grant Discover's motion only because he spoke of expediting the case. I believe that he will grant it will because it is essentially the same request that he verbally ordered early on in the case. I don't see any reason that he would reconsider since it has not changed materially.
