The new patent differs from the old in that it covers autonomous cars. It is unlikely that many(maybe any) of the current violators are scoring the driving performance of a driverless car. So the original patent is probably all he needs to move forward on lawsuits. The second patent expands to cover an area that the first may not have.

BTW, since the second patent doesn't include Mark from PU, I've been wondering if the mystery 2.5 million dollar expense in 2021 was a payoff to Mark for the patent rights in the second application.
