A settlement conference and an Alice101 ruling should not even be allowed before a Markman Hearing. Judge Donato very well knows nothing will be accomplished in that conference. Let’s hope he uses the same logic with regards to an Alice ruling the 2nd time around.

I think the cases are too far along in Waco for him to override j. Albright. Do you think he’s aware of our strong showing in all of our Markman’s so far?
