Thanks Robert - it would seem that shareholders would have a good MQD case if an Admin Action was proposed without a settlement with shareholders. The statements by the Chair of the CEA would be used to argue that the proposed Admin Action should be approved by Congress and the CEA Chair had stated in the past.

Seems like this could be a campaign issue though - that would be interesting.
