Do they really want to let a POTUS interpret a statute based on political opportunism?

The previous US Treasury Secretary, Steven Mnuchin said in 2016 to Maria B., "the cash sweeps were used to fund Obamacare".

If true, there should be intragovernmental emails, documents, and discussions that while protected by Executive Privilege may be allowed to be viewed in camera by a Judge only to determine whether or not the POTUS directed the UST to do the NWS because he couldn't get the money appropriated from the US Congress.

When the Executive Branch appropriates funds from directing federal agency action to access those funds, this may violate the Seperation of Powers Doctrine or the MQD or other Constitutional problems.

It's analogous to Burwell I, or DJT appropriating funds for the wall, or JB appropriating money for his pet project, the student loan forgiveness campaign promise, that none of these men could get our elected representatives in the US Congress to agree to do.
