The confusion is ------ I have thought that it is the NWS and every penny taken by GOV that is the nationalizing of .... And you note the court said that is allowable because it is blessed by the nature and wording of the incidental Powers provision in HERA

If not the NWS ---- what is the argument that F and F have been or were "nationalized" that is left to call a Major Decision -- that somehow falls outside the incidental HERA powers?
