Other provisions of the law are aimed at encouraging greater production of critical minerals in the U.S. $40 billion commitment authority for the U.S. Department of Energy’s Innovative Technology Loan Guarantee Program (Title XVII), on top of DOE’s existing commitment authority of approximately $24 billion. The Innovative Technologies Loan Guarantee Program authorizes loan guarantees for projects that (1) “avoid, reduce, utilize, or sequester” air pollutants or anthropogenic emissions of greenhouse gases; and (2) employ “new or significantly improved technologies” as compared to commercial technologies in service in the United States at the time the guarantee is issued.

(a) DOE, after negotiation of a Term Sheet with an Applicant, may offer such Term Sheet to an Applicant or such other Person that is an affiliate of the Applicant and that is acceptable to DOE. DOE's offer of a Term Sheet shall be in writing and signed by the Contracting Officer. DOE's negotiation of a Term Sheet imposes no obligation on the Secretary to offer a Term Sheet to the Applicant.

Definition of a Contracting Officer in paragraph above:
Contracting Officer means the Secretary of Energy or a DOE official authorized by the Secretary to enter into, administer or terminate DOE Loan Guarantee Agreements and related contracts on behalf of DOE.

There are a number of potential sources of U.S. federal funding that could be applicable to NioCorp, AND WE ARE ENGAGED IN PURSUING ASSISTANCE THROUGH MULTIPLE PROGAMS & AGENCIES. We do not comment on the details of these efforts unless and until a public announcement is allowed and/or required.

NIOCORPS ELK CREEK MINE IS THE LARGEST PROVEN NIOBIUM PROJECT IN THE UNITIED STATES. NIOCORP WILL ALSO PRODUCE TITANIUM & SCANDIUM & (SOON MAY ADD VIABLE RARE EARTH MINERALS UPON COMPLETION OF DEMONSTRATION PLANT OPERATIONS NOW ONGOING!)

IMHO: NIOBIUM, SCANDIUM, TITANIUM & the viable REE's Niocorp's Elk Creek Mine will produce are being utilized for Batteries, Aerospace, Defense, NASA, OEMS, Automakers, Additive Manufacturing & a host of other technologies. These Critical Minerals have been & continue to be researched & improved upon (High Entropy Alloys, 2-dimensional Matrix's, Nano particles & tubes... the list goes on & on....) That is why so many here have been invested so long. Will "Common Sense" prevail finally? Will The U.S. & Private entities finally realize they need to come together to re-establish the U.S. & Allies Rare Earth & Critical Mineral supplies well into the future? Or not....
