That is a fallacy, your broker can ALWAYS lend your shares out.
While I'm a subscriber of Fintel, and have seen the reported short position on MGON, I find it hard to believe that anyone would be shorting sub pennies. That being said, IF a brokerage can loan the shares that have a pending sale order, it does no harm to mess with the "man".
The way I look at it, locking them up is a pretty easy thing to do, just in case it does leave them second guessing the stock. Either way, I'm sure the little people are going to have no effect in playing a game that is rigged against us.
