I can imagine a metric they can use for monetary damages. Maybe the revenue HDC lost due to an Intel/HDC licensing agreement. I have to imagine, there is some formula used for similar lawsuits.
At this point, we’ve proved the guilt of Intel’s infringement. So, if it does go to trial, I would think the burden is on Intel to prove they didn’t need our patents, since that very need is ex post facto (probably screwing up the Latin).
Just seems like a bad defense, “your honor, my client is innocent of stealing the car, because he had another one in the garage.” Of course, to extend the metaphor we would be arguing over gas and wear and tear reimbursement.
“they just happened to make a bad choice in using the HDVY algorithm.” This could be the very definition of a specious argument. How unfortunate for Intel to have had a myriad of options at their disposal, but happened to pick the one seemingly most litigious.
Let's hope it doesn't come to this.
Even the mere mention that this is a scam shows a profound lack of DD, critical thinking skills or honesty.
