You talk about "legal firepower", but I view that as very low in this case. How many depositions have been done? How many requests for discover? AFAIK Intel has not even deposed the authors on the patents, nor any of the staff of HDVY. There have been a few experts testify at the existing patent trials, but that is kind of a minimal effort. Trials are certainly expensive, but the only way to a large payout is through a Jury trial. IF Intel were to set the precedent of a large settlement here, it would break them in future patent costs. It is often not appreciated how many thousands of patents Intel needs access to in order to run their business.
As an aside, the large settlement VLSI got recently is still in appeal, and will be for several more years.
