That seems like a bad strategic decision on the Plaintff's lawyer's part if they argue that. It will seem like hedge funds are trying to get the 5th circuit to help them screw common. I dont think Plaintiff's lawyers will argue that if they have the opportunity - hopefully we will see sometime in 2023.
