No no no. This is a categorical error of logic. We have all made the same mistake. We cant ask for the NWS to be cancelled by a court. Why? Because Hera says you cant question the actions of the conservator. Hera is not the problem per say. The Conservatorship is not necessarily a problem. The law allowed treasury to purchase GSE securities for a limited time to stabilize the market and the GSEs. That should have been a good thing. You can’t say cancel the NWS but be fine with the 10% dividend and warrants. That is illogical and self defeating. You cant challenge the conservatorship because that shouldntnt have caused the problems we are dealing with. The administrative state conspired amongst itself to instead of follow the law as written, create a one party self dealing agreement “Contract” that bastardized the intent of Congress when writing HERA. No, we must begin to fight against the illegal contract and only the contract in its entirety. If I remember correctly the original APA claim by Berkowitz challenged the self dealing, but that was denied because at the time FHFA director issue was considered independent of the President. Well the Supremes overruled that notion. This is the only legal theory in my opinion that can solve the issue.
