What Tad should have done (now that I have thought about it more)-

1) Tell Ken to keep his F*****g mouth shut about business matters and act like an adult. He has plenty of time to destroy the company if he actually gains control of it.

2) Not mention the RS at all in public, and just do the RS when the name / ticker change occurs (IF any of this happens at all). That would let this run for a while.
