ALL- Sharing responses to questions on 2023 NDA passage 1/2/2023:
Given the passing of the NDA 2023 into Law. It brings up an ideal time to circle back & ask for an update on the following questions for early 2023!

Within this topline, the legislation authorizes $816.7 billion for the Department of
Defense (DOD) and $30.3 billion for national security programs within the Department of Energy (DOE).

Building Supply Chain and Stockpile Resilience
~ Authorizes $1 billion for the National Defense Stockpile to acquire strategic and critical materials required to meet the defense, industrial, and essential civilian needs of the United States.
~ Requires the National Defense Stockpile Manager to submit a briefing on strategic and critical materials shortfalls.
~Requires the DOD to track the sourcing of contractor-provided rare earth elements and critical materials.



#1) Jim: Can you offer comment on how the recent NDA 2023 legislation Might benefit Niocorp & the Critical Materials it will produce in the future?

There are a number of potential sources of U.S. federal funding that could be applicable to NioCorp, AND WE ARE ENGAGED IN PUSUING ASSISTANCE THROUGH MULTIPLE PROGAMS & AGENCIES. We do not comment on the details of these efforts unless and until a public announcement is allowed and/or required.


Follow up- Would Niocorp seek/offer to employ Source Tracking methods once in production?

#2) It appears the 118th Congress will have several Bills dealing with Legislation that Might benefit Niocorp & the mining industry in the future. Could you offer comment on the following (Should any be enacted & signed into law). How might they benefit the mining industry & those projects seeking to produce Domestic Critical Minerals? .... Or is it too early to tell here?

Resonse:

All of these bills contain provisions that would be helpful to U.S. critical minerals producers such as NioCorp. None of these bills are likely to pass in their current form in the 118th Congress, given significant opposition to some of their provisions by a variety of Members of Congress. It is also unlikely that President Biden would sign any of these bills in their current form, should they be passed by the Congress.



Jim- Circling back in early 2023 can you offer an update or comment on the following:
#3) Has Niocorp recently applied for a DoE/LPO loan for "debt"..? & continuing engagements & discussions with Federal Agencies or other entities into 2023?

We are unable to comment on this, per agency rules.
