Him not being a named party or served with process will end up being a major jurisdictional defect.

Sorry if you think writs are unfair. Ironically, their purpose is to avoid unfairness that would result from not allowing someone an adequate remedy. Thus, if someone lacks standing to appeal, they are provided an equitable remedy to ensure fairness.

The key will be what the court decides if it grants the writ.

If someone can't tell that a shell is a shell, can you trust anything else that they say?
