Prerequisite for a capital raise is that (almost) all lawsuits have been settled beforehand.

That takes time during multi Billion dollar litigation against Defendants with unlimited resources and time.

What exactly would prevent a Shareholder from initiating yet another lawsuit after the current round has ended?

The D's could settle with the shareholders but why would they with only meaningless P victories so far?
