Problem is no judge dares to make the call, not even the SCOTUS. They forget they have the responsibility to uphold the law.

On second thought, we may do the same if we were a judge in District Court, Federal Court, Circuit Court, Appeal Court, etc. Why not the Justices in SCOTUS make the call ? They become too political, in some sense. IMO.
