The federal government (just like stock market investors do) suffers from 'recency bias', walking away from court cases with pyrric wins for the Plaintiff Shareholders and/or just wins for the Gubmint.

When it's the Gubmints chance to present their case, they will play up how the public interest was somehow served by the NWS and that the "integrity of the MBS Market' was somehow saved by the NWS.

Will the Jurors buy what the federal government is selling? We'll see what happens.
