I think the plaintiffs have a good chance of winning, but not a very good chance of getting more than the share price drop from the day before the NWS to the day of. Everything else the plaintiffs have tried to bring up has been denied.
If that ends up happening (plaintiffs win $1.6B plus interest), I could see both sides appealing. The defendants will try to get the award denied completely, while the plaintiffs can ask to have the CAFC overturn Lamberth's decision to not allow the larger damages theories.
Naturally, no award or an award of zero will be appealed by the plaintiffs, and anything else will be appealed by the defendants.
