Kthomp, are you negative on potential Lamberth damages beyond 2012 decline in share price (including pre-judgement interest)?

At this point I'm afraid so. The two main damages theories that the plaintiffs put forth - expectancy and restitution - both got denied by Lamberth. He also did not let them supplement Mason's report to include reliance damages, which would have been equal to the restitution damages.

I'm not sure what the plaintiffs will be allowed to present, but the testimony of their main damages expert has been gutted.
