No, the DOJ and the Federal courts do nott allow defendants to pick their names. They MUST use their real name in court, such as pleading, allocution, and sentencing.

However, the problem with your thesis is that MARK MILLER (the guy who was arrested, fingerprinted, and booked, then was arraigned and showed up in court) is not MARK KILCHESKY nor RICHARD KILCHESKY. The person who was fingerprinted and booked and appeared in court is the person who will be going to prison; and that person is MARK MILLER and not anyone who was ever named KILCHESKY.

This bizarre assertion re: KILCHESKY being MARK MILLER is just plain and obviously wrong, and it makes no sense at all. I doubt if anyone besides one person believes the absolutely ridiculous crap about any KILCHESKY being MARK MILLER.
