Just to add the following from the NRCP "rule book": 16.1 (e) (1)
Seems technically he could have dismissed case against JPEX but decided to allow a continuance based on the fact that both parties agreed to "complete performance" by Nov. 1, 2022.
Is that how you understand the situation?
