You are incorrect...
Court of appeal in this case is only looking for potential errors of law in the lower/District courts findings -and/or- if the evidence presented initially was legally sufficient to support the district courts order in the first place.


The ONLY time new evidence might be allowed (key word "might"...) is if it could be shown that evidence was discovered prior to the entry of judgment by the lower court and was disallowed.

That is not the case here.
