The appellate court may very well be reviewing it in real time.... Or perhaps it takes more time... Its anyone's guess really.

No, he wont get his day in court ...

They are not retiring the case, nor will they hear new evidence... Thats not what an appellant court does. It simply reviews the application of the law pertaining to the case being appealed.

The "settlement conference" phase has been concluded which is a procedural -go to- normal protocol part of the process. Now that it has, I'm betting that things are moving towards finally where the appellant courts decision is concerned

In other words, this will get reviewed by the appellant court, and a decision will be rendered based on the application of the law within the previous courts decision.

This guy walks up to me at the horse track... As I placed my bet he scoffed at my pick. ....Then offered to by my ticket for half price..
