Might "preparing litigation" be enough to bring Calasse to his senses and settle reasonably?

Or is there something about the legality of the process/procedure in which the lower courts decision was handed down (a loophole of sorts??) that would bring it in to question... thus my statement:

Without talking to "My Guy" yet, I'm assuming that Sharp is trying to prove a breach of fiduciary duty in order to show that Calasse has no right to the shares in the first place. If that is the case, I would assume that means that Calasse presented something (to the appellant court) that puts in question the legality of the lower courts decision. (??)



I am certainly NOT an attorney.... I will ask my neighbor ie partner in the firm my wife works for as soon as he has the time (which should be by end of day/early evening)
