i got this from tda as an attachment to the email response below. it was on tda letterhead. a cya letter.

here is my response.

 the only reason why i wouldn't get my ape shares is because i would own naked shares. i purchases amc shares under good faith that i was getting real shares, not shorted naked shares. i have them in cash accounts and have open sell orders on them so my shares should not have been lent out if they are. if i don't get my ape shares next week then i expect that tda will buy back my amc shares at my current open order price.
