Calasse wasn't found guilty of fraud anywhere. The SEC case was a complaint (not judgment) and didn't name him as a defendant.

Also, whether he did anything that could result in jail is debatable (I don't see anything myself, but I'm just an investor stupid enough to invest in penny stocks), but the statute of limitations has clearly expired.
