This case isn't exactly a spam dunk.

Is gonna be hard--if not impossible--to prove that recap would have even happened given two extra years with Calabria. I also don't know how you're supposed to put shareholders in the position they'd be in absent the removal provision, without trying to compel the current administration to implement some ambiguous recap plan from the last administration.
