Anyone else having doubts. the most important thing you can do is read the court documents and try to get a feel for what both parties are trying to accomplish. you have to understand where the case is at and what just happened. I've posted the documents on Reddit but they are also available on court listener. Read the judge's decision from May 5th. Google has zero intervening rights on claim 16 they lost the motion to strike and Netlist won partial summary judgment on claim 16. Samsung no longer has a license because they lost the breach of contract case. Google does not have a license and they are trying to rely on Samsung having a license which was lost as mentioned above. Samsung's Only Hope was to run to Delaware in a Hail Mary attempt to get a Delaware judge to delay the case and ask for a declaratory judgment they are not infringing the patent. in the meantime you also have netlist fighting Samsung in Texas and in California you have an appeal from Samsung to the court of appeals on Judge Scarsi decision. judge Seeborg in his intervening rights decision specifically told us that claims 16 Google has no intervening rights and the other claims of the 912 patent they have absolute intervening rights. the current attempt at fear uncertainty and doubt is trying to trick people into thinking that we can only go to February 8th of 2021 on all the claims. this is obviously not true or you would not even have the Delaware case and the judge would not have issued partial summary judgment on claim 16 in netlist favor. in his intervening rights decision the judge goes through the discussion and thought process on why he denied Google's motion to strike claim 16 and it was because it could not have been asserted prior to 2014. that is why he allowed netlist to add claim 16. it goes back to 2014. however even if you just take the time. From February 8th 2021 forward Google does $200 billion per year in Revenue. they cannot argue anymore that this last year in particular was not willful infringement. they've been on notice for a while. even if netlist gets 1% of sales and profits for the last two years * 3 you are talking a lot of money.
