why aren't they settling the note which is the biggest issue facing the company?I

I know you pose this question already knowing the answer, but I'll address it.

Settling the note is not an "issue" for them at all......it is the whole scheme for them, it is the way they are ripping off their investors. To the tune of a $100 million or more, so far.

That note is everything to them. The conversion price is set so incredibly low that it will never go away, which is exactly what they want.
