The Supreme Court said last week government agencies cannot create, change, or abolish established rules or laws. They must work within congressional guidelines. Crypto was never approved as a security to regulate. The SEC cannot unilateral determine what is and isn’t a security. They do not have that authority. If they did, they could regulate trading of comic books, coins, stamps, sports memorabilia, etc.

The judge in this case called the SEC hypocrites in how they’ve cherry picked what constitutes a security and what doesn’t and lack the authority to decide. Only Congress can do that by passing new laws.
