not sure but when they say on page 13, “Even if applicable…” does not show confidence to me in the arguments. why write 13 pages and then say even even if applicable? it is applicable that is why you wrote 13 pages. may be I am overthinking this. i was very confident in rop until see things like this from thompson, don’t think he was the one in oral arguments. he always disappoints.
