Also say this is a takings case-why isn’t this a takings case?

I keep seeing this thrown around as if all 9 SCOTUS judges agreed this was a nationalization. When in fact it was one off hand comment during oral arguments by Justice Breyer (one of the liberal judges). None of the other judges made any hint or implication that they think this was a nationalization. So it's a stretch to say because one liberal judge asked "why isnt this a nationalization" once during oral arguments, all 9 SCOTUS judges agree with that view.
