Just noticed that last week that Judge Stickman is allowing the LifeMD case against Lamarco and Culper to continue - albeit two counts being dismissed. The remaining counts are basically along the lines of defamation and libel that has the potential to set some legal precedents...and not in the favor of those making negative "opinions". Very interesting read in the court filings.
The remaining counts:
- I: Defamation
- II: Trade Libel
- III: False Light
- V: Deceptive Trade Practices
- VI: Unfair Competition
- VIII: Aiding and Abetting
Here's the court filing saying that the case will proceed and NOT be dismissed as Culper/Lamarco had tried to argue. This should be interesting. Lots of "activist investors" short on a stock publishing similar articles that could potentially be in for some further investigation.
