Thanks. All I can say is the MCFC's, FCE's core technology, cannot be defined as a "project patent" under the JDA (Section 6 & 7). Exxon's claim from their own website:

"position ExxonMobil’s Rotterdam refinery as an attractive location for a hydrogen project with CCS and for pilot testing ExxonMobil’s carbonate fuel cell technology."

Exxon did not enter the JDA with a MCFC. Modifying FCE's patented, pre-existing technology does not give them ownership of the original MCFC patents. Exxon does not have a patented carbonate fuel cell. Hopefully the company will clarify.
