Your argument isn't even valid.

One, I said there could very well be no ex-date. In which case they will use the record date. So you already qualified if you sell today.

Two, if there is an ex-date, it will be according to exchange rules, One day after the pay date for large (>25%). dividends. You have a responsibility to know the rules. FINRA hasn't announced the dividend yet. People get "screwed" here all the time because they don't know the rules.
