If (“if”) they would've made up the whole application, wouldn't the SEC stop them for blatantly lying to the public a long time ago? This is something the SEC can easily verify, whereas the FDA doesn't usually publicly discuss information relating to Pre-IND and IND applications, they are not obligated to confirm the existence of ongoing applications either. That is for companies to decide in their press releases.
