So Bennie will not know what his sentence is until he is actually sentenced by the judge. The judge has sole discretion - and also will have the PSIR to help him decide - which the prosecution does nott have when the plea agreement was made.
In sum, all a plea agreement can do is, at most, to have the prosecution recommend a sentence range, but this has zero binding effect on the judge who has sole discretion as to he sentence imposed.
