Yes, a chance. We won't know for quite awhile though, as he won't be sentenced until much later after next weeks allocution - at least 4-6 months after he pleads guilty. And then, the court can move back the sentencing date if the DOJ wants to postpone his sentencing until after they use him at the Foley-Coyote trial.

So it may be quite awhile before we know Bennie's sentence.

My estimate is that he will gett from 4-12 months if he has no prior criminal record and he has family to support ... AND if he is fully cooperative with the Feds (DOJ, IRS, SEC) and what he has is helpful to them in nailing the Coyote-ass to DaHole for the Long Goodbye.

So Benny might get probation, butt forging that check cancellation stamp is a very badd thing. I expect he will get some camp time - butt nott so much it ruins his ability to provide for family members - 4 to 12 months ought to be a good enough lesson for him.

Butt that is a guess because we don't know all the facts of his case (we will learn some in his allocution) nor what the following pre-sentencing investigation report (PSIR) done by the pretrial and probation offlce at the US Marshals office will say about his background (prior offenses, character, family relations, education, work history, finances, etc.). The judge will CONsider all that junk AND the DOJ's recommended sentence and the Sentencing Guielines calculation and then he (the judge is a he) will decide whatever he wants.

I can see him getting anywhere from 0 to 24 months. Unless there is more to the story than we know from the indictment and/or comes ~OUTT in the PSIR.

Foley-Coyote OTOH is gonna gett absolutely slaughtered at his sentencing. I do nott expect that he, with his record and pulling this scam while serving time in Federal prison for two separate convictions for fraud, will gett anything less than serious double-digit years. And in the Federal DaHole, you serve 85 percent of your sentence. It is doubtful that Foley-Coyote will leave prison in anything other than a pine box, although he conceivably could live that long, butt medical care in DaHole is badd. If you are gonna have a heart attack or stroke, don't have it in prison. By the time they get you to a real hospital, it'll already be too late many times.
