I’ve read the whole prelim injunction court transcript and it’s even more bullshit than I thought. Hovendicks lawyer states irreparable harm is that HD was unable to vote on the board of directors and the merger. They also say that they do not want to permanently delay the merger. The issue of the shares cannot be reason for injunction because it can be cured with monetary action so they are using bullshit excuse of him not being able to vote. I understand why judge gave injunction. It was for them to figure out a way to revote even though HD cannot change the result.
