Over the years there was a lot of confusing and misleading information posted here. From the onset, ATVI NEVER denied using the technology or patent developed by WDDD. The position that ATVI took from the very beginning was that the technology was NOT eligible to be patented. This is why the 101 is a knockout factor. Also, many many people here were of the (wrong) opinion that this had already been decided by the PTAB. I tried (unsuccessfully) to explain that here to anyone who would listen. The decision on the 101 rests soley with the District Court. As the CAFC stated, what the PTAB did was irrelevant. Now the CAFC affirmed the decision of the District Court.
