It is incredible, how much power these entrenched, un-elected bureaucrats, have in their hands. The environment breeds corruption. There is no exercise of 'discretionary authority' unless the decision-maker wants to decide to disregard standing laws.
That OUGHT to be a big deal, but it isn't. The law is disregarded as a matter of routine. And this abuse of discretionary authority has had a negative impact on this company throughout our history, starting with the SEC's failure to control the naked shorting of Kalobios' stock, and leading to the FDA's self-appointed power, which it granted to itself last May, to "Decline" an EUA sought by companies trying to bring Covid products to market.
