And the reason this is still open:
Its awaiting the outcome of the criminal proceedings. And THEN the outcome of the SEC Civil prosecution against both Berman Personally and DECN as a corporate entity.

Berman is still VERY VERY MUCH on the hook, w.r.t. the SEC. He is in fact in so much hot water there that his woollens have shrunk completely!
