Criminal cases offer defendants a bit more protection in terms of rules of evidence and testifying. Plus, there is a different standard of guilt. If Berman does not testify in a criminal trial that cannot be held against him in the trial, whereas in civil proceedings it can be.

The standard of evidence is only a preponderance of the evidence in a civil case as opposed to reasonable doubt. The judge has much more leeway in allowing evidence.
