The FDA very likely tipped-off the SEC who showed the evidence to the DOJ who thought there was enough to investigate. That's the start -- with the numerous other stock frauds and insider trading, there is a whole quagmire of actions to investigate, document and put into a charging document.

Ghost-written articles, social media pumpers, misleading press releases and cc's will add considerable evidence.
