It's the most one sided corp fraud case I've ever seen. The same defense team who's main "victory", out of all their motions filed, was to be given a choice of admitting misuse of funds for personal expense (fraud), or allowing the DOJ to present the web porn expenses in detail, is going to be defending him against these charges!

From reading the docs, one part of the defense is, "well we filed an FDA application"? They've got to be kidding! Filing an application means there isn't fraud? This is equivalent to the "CBS interviewed Berman, and they wouldn't do that unless they knew Genviro was real". That line sure aged poorly!

If this were a boxing match it would be one punch and over.

If his lawyers are sane, I cannot imagine them giving Berman the option to actually go to trial. But this is Berman, and this madman might just say "I'm paying you, and we're going to trial". I believe he is delusional enough to actually believe he is innocent.
