let me explain: the executive branch cannot have legislative or judicial branch powers, that is the separation of powers



Like it or not the executive branch does have certain quasi judicial and legislative powers. The different departments make rules all the time (FCC) legislative and the also have enforcers that can fine or penalize (SEC, IRS) Judicial.


now to come back to your question, ALL branches(1,2,3) have a fiduciary duty,


Who do thay have a fiduciary to? The President or the public?

and executive agencies do have a fiduciary duty, and because it is executive it cannot have Judicial power as it would violate the separation of powers


A fiduciary to whome? As described above executive branches do have some limited judicial power. Even State boards of professional licensing have limited judicial power (Bar Association, Realtors Association, etc...)
