Hey diarch, Saw your post today and then found this one in your history.

Retrospective on the preceding KB scam with JnJ-did we ever learn the amount of the settlement?



I probably posted this a long time ago, but not in response to this old post of yours.

If you look at DECN's financials in the quarters after the "settlement", you will see no gains/bumps from a settlement anywhere in the financial statement. None! Nothing changes other than the typical quarterly destruction of equity.

The important basic accounting principal, is that even if settlement funds received by DECN were put into some kind of contingency account, or whatever his excuse was, THE IN AND OUT MOVEMENT OF THE FUNDS, BY LAW, WOULD NEED TO BE SHOWN ON THE QUARTERLY FINANCIALS. They aren't!

So, there are 2-3 possibilities

1) the "settlement" amounted to little more than both sides agreeing to end the case. (For sure, Berman could have said he wanted $100 or something like that, so he could make PR claims of a financial gains)

2) there were funds from a settlement, and Berman took them!

3) fraudulent accounting (related to 2) )

What is not possible is that DECN received a significant financial settlement. They lost the freakin case on a summary judgement! This amounts to a race ending as soon as the starter's gun goes off!

Only DECN shareholders would be naïve enough to think that someone losing a case on a summary judgement is going to win significant $$$ in a settlement of that case! Berman has and had them eating out of his hand on this!
